INLAND WETLANDS/CONSERVATION COMMISSION

THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

ITEM:  CONSERVATION COMMISSION
Folger:  This weekend the scout project to rehab parking lot on Sullivan Ave. for Donnelly access will begin.  The parking lot will be cleared and a rail fence built around it.  A second scout project will be to make a trail from this parking lot connecting to the woodland loop in Donnelly.

On July 6th Folger will give a presentation on water at the library as part of their summer program series offered to children & parents.  The presentation will be on water in South Windsor where kids can identify where they live and what major watercourses are near – to basically raise their awareness of water resources around them.  Pocket nature guides will be handed out – specific to different regions with a variety of themes, such as birds, trees/shrubs, night sky/stars, etc; are laminated, fold-up, handy and easy to carry.  In future, these guides may be available for sale in Town Clerk’s office.

ITEM:  WETLAND OFFICER’S REPORT
Folger:  Though have had some heavy rains, most construction sites have held up fairly well.  Some repair work to silt fence at Dzen’s was needed, but the detention basin is holding very well.  Warren asked if the construction site for the church on Chapel Rd is overly excavated.  Folger stated that it is a very sand site so process has been brought in for the parking area.  There has been excavating for the detention basin so there may be some stockpiles.  Controls are in place, no tracking onto road.
PUBLIC HEARING 7:15 pm
Show Cause Hearing – Crispim - 51 Foster Road, Wetland violation

A certified letter had been sent to Francisco and Maria Crispim and received by Francisco Crispim prior to this meeting. No representative for Mr. and Mrs. Crispim was present at this hearing.  

Folger reported the details of events leading up to the cease and restore order being issued:  received a complaint from a neighbor – water accumulating on property; fill place over wetlands – which causing water to accumulate on neighbor’s property; activities occurred without permits; partial remediation by drainage ditch being dug but fill not removed as instructed – timeframe was established and not adhered to; large debris dam of logs, brush and fencing to be removed from  watercourse has not been done as specified.  Cease and restore order states to cease any further clearing and filling, locate the wetland boundary in the field and contact this office for a site inspection.  In addition, the order states to cease any further clearing and grading activities; remove the fill material where the large boat is currently parked, as designated on the enclosed map and restore flow to the swamp to the south; remove the debris dam from the watercourse; stabilize the areas with grass seed or hay mulch.

Commissioner Muller asked how can we regulate this now when current zoning regulations were not in effect at the time the Crispim’s purchased the property over 20 years ago.  Folger stated that the activities constituting the violations are recent, these activities have caused problems for neighbors who have filed a complaint and it seems reasonable to try to remediate.

Folger said the Crispim’s have until July 9, 2010 to comply with the provisions of the cease and restore order to avoid legal action initiated by the Town – fines and a caveat recorded on the property are possible.

Appl. #10-30W – Town of South Windsor – Main Street Bridge Reconstruction Project – IWA/Conservation Commission application for the reconstruction of the bridge at Main Street including associated improvements to the drainage and stormwater structures.  The site is located southerly of Strong Road and northerly of Governor’s Highway.

Jeff Doolittle and Joe Perna, Engineering Dept/Town of South Windsor presented application.  Bridge was built in 1938, needs extensive repair – deck, superstructure (steel support beams) and sub structure.   Approval from Army Corp of Engineers and DOT will also be necessary.  Would like to start project early next spring and be completed by fall.  Main Street would be closed during bridge repair.   Drainage patterns, which are poor, will be improved.  Work is within upland review area.  Commissioner Kelly stated that section M on the Inland Wetlands, Watercourses and Conservation Application and #11 on the Statewide Inland Wetlands & Watercourses Activity Reporting Form must be revised to reflect the accurate amount of lineal feet of proposed stream alteration, not the zero amount as stated.  The correction will be made.

Commissioner Warren asked if the encased sewer pipe will stay as is?  Yes

Commissioners Warren, Kelly, Brower, Phillips and Muller visited site.

Ginny Macro, 1828 Main St. (Chairperson, Historic District Commission), was at the meeting to see what  the bridge will look like once completed.  It will look very much as original.

Alternative:  Only option to not altering the stream would be to not do the work and leave bridge as is, which is not feasible.  By removing the meander would help with erosion, etc.

Motion to:  approve Appl. #10-30W – Town of South Windsor – Main Street Bridge Reconstruction Project – IWA/Conservation Commission application for the reconstruction of the bridge at Main Street including associated improvements to the drainage and stormwater structures.  The site is located southerly of Strong Road and northerly of Governor’s Highway, with the following standard conditions:

1.      The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
3.      The permit is valid for five years and shall expire on June 16, 2015. It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
4.      All approvals required must be obtained and submitted prior to any activity on the site.
5.      A contact person shall be identified on the plans.

ITEM:  NEW BUSINESS:

Appl. #10-28P – Town of South Windsor – Nevers Road – Conservation Commission application to construct an addition to the Senior Center and associated improvements on property located easterly of Nevers Road.  RR, Rural Residential Zone

Galen Semprebon, Design Professionals, presented the application.  .67 acres to be disturbed- to make parking lot handicapped accessible/to meet handicap law requirements.  PZC has approved application.  All drainage from site will ultimately into swale across Nevers Road.  Perimeter controls are more than adequate.  Rain garden not proposed – not room for one.

Motion to:  approve Appl. #10-28P – Town of South Windsor – Nevers Road – Conservation Commission application to construct an addition to the Senior Center and Associated improvements on property located easterly of Nevers Road.  RR, Rural Residential Zone, with the following standard conditions:

ITEM:  OTHER BUSINESS:
Folger advised the commissioners that an applicant asked if a special meeting in August would be possible.  Phillips said traditionally do not accommodate August meetings, felt that if they are in a hurry should be ready in July.  Warren doesn’t have a problem with having a meeting in August, especially due to economic times.  Muller says August would be good for him.  Warren suggested polling the absent commissioners for their input.
